Terms and Conditions of Sale

Prices

You agree to pay the price as quoted on your signed order form, or if your booking has been made via Facebook/email, that which has been stated in your order confirmation.

All of my prices exclude VAT. I will inform you if I become VAT eligible.

Bookings and Deposits

All orders and booking dates are only secured with a non-refundable deposit.

Once deposits are received and cleared your booking date will then be fully secured. All wedding Cake orders require a non-refundable deposit of 50%. Other celebration cakes and cupcakes require a non-refundable deposit of 25%.

For cakes booked 12 months or more in advance, a smaller initial deposit may be agreed. The remainder of the deposit will then be due 6 months prior to the date the cake has been booked for.

Final Payments

For wedding cake orders, full balance is required 4 weeks prior to the cake delivery date, as specified on your order form. Failure to make payment of the remaining balance may result in your order being cancelled and your date being made available to someone else.

Final payment for all other orders can be made on collection.

Payment methods accepted are cash, cheques or bank transfer. Cheques are to be made payable to ‘Simone Louise Cakes’ and sent to the address found on your order form. Please allow an additional 5 working days for cheques to be banked and cleared. Please write your name on the reverse of the cheque.

Bank details will be made available on request if you wish to make a bank transfer.

Late or Non-Payments

Late or non-payments could result in loss of your booking date. In the event of a late or non-payments your order will not proceed until alternative funding has been agreed and payment made in full. In these circumstances, subsequent completion of the order on the required date will not be guaranteed and becomes Subject to Availability.

Cancellations

Wedding Cakes: 4 weeks or more: the total deposit paid will be retained.

Less than 4 weeks: 100% of total cost payable.

Other Celebration Cakes: the total deposit paid will be retained.

All cancellations must be made in writing. Verbal phone cancellations will not be binding.

Unforeseen circumstances / Illness

In the event of any unforeseen circumstances or illness that results in Simone Louise Cakes not being able to fulfil your order, I would endeavour to find an alternative cake decorator who would be able to do so. However, if this is not possible, or if you do not wish to use the substitute decorator, a full refund will be given.

Change of Wedding Date

If, for any reason you wish to re-arrange the date of your wedding, I will try my best to accommodate these changes without any additional charges, provided sufficient notice is given and I am able to provide a cake for the re-arranged wedding date. However, if I am unavailable on your new wedding date and cannot provide the wedding cake, it will not be possible to refund your deposit. The limiting factor with any cake provision is usually the cake set-up. As a compromise, it may be possible to provide you with a cake prior to your wedding date, but under these circumstances it will become your responsibility to collect, deliver and set up the cake at the venue. If you cancel your wedding cake order with me after requesting a change of date no refunds will be made to you (the client) under any circumstances.

Change of Cake Design

Should you wish to make changes to the original agreed design, I will do my best to accommodate, however, additional charges may be applied.

No alterations will be able to be made to wedding cake designs once the balance has been paid, 4 weeks prior to the wedding date.

Stand Hire

I have a variety of cake stands available to hire at a cost of £5 - £10 per item. A refundable deposit is required for each stand, in addition to hire charges. This will vary depending on your chosen stand.

Your deposit will be refunded once the stand is returned in good order, within the agreed time scale on your order form. Any damages and cleaning costs will be deducted from the deposit. In the event that damages are excessive, or a loss has occurred, the full deposit will be retained.

I will be happy to offer guidance on the suitability of your requested cake stand, taking into consideration the size and weight of your cake, as some stands will be more suitable than others.

Delivery/Collection

Collection: On the day of collection, your order may be collected at a pre-arranged time, as agreed on your order form or via Facebook/email. Should you wish to change the collection details I will do my best to accommodate, however, cannot guarantee availability.

If you or your representative elects to collect and transport the cake, you assume all liability and responsibility for the condition of the cake once it leaves my premises.

You should prepare your vehicle so it has ample room for the cake and is free of items that can roll or slide into the cake.

I will do my best to provide a well-structured cake, but please note that cakes are fragile and can be damaged easily.

In hot weather it is always advisable to transport your cake in an air-conditioned vehicle.

Deliveries: I will deliver at the time and address agreed with the customer on the order form or Facebook/email confirmation. If I cannot deliver because there is no one to receive the product or the address provided is wrong, the product will return to my address and be held for a maximum time of 24 hours.

Delivery/Setting Up Your Cake At Venues

Cakes should be inspected on receipt to ensure they were not damaged in transit, as you (or any third party taking delivery) shall be solely responsible for any damage to any product which occurs (i) after the delivery or collection of any product and/or (ii) as a result of failure to follow any instructions/advice I may give in respect of storage or setting up or of further transportation of the cake(s).

Consideration should be given to where you display your cake, particularly in hot weather. I cannot be held responsible for any damage that may occur to a cake as a result of weather conditions. It is advisable to display your cake in a cool air-conditioned room, away from direct heat and sunlight. If your event is in a marquee, conservatory or a room without air-conditioning, the heat and humidity may affect the quality of your cake.

Photographs of your Cake

Simone Louise Cakes reserves the right to take and use photographs of your cake(s) for marketing and promotional purposes.

Other

Where colour matching is requested, I will do my very best to achieve the colour required. However, I cannot guarantee an exact match.

Simone Louise Cakes reserves the right to replace one or more tiers of a cake with dummy tiers if deemed necessary. The actual cakes would then be supplied separately, so you would still be provided with the required number of portions agreed on your order form.

If you have requested a buttercream cake design, it may be necessary to change to a fondant covered cake if there is particularly hot weather forecast for the day, or surrounding days, of your wedding/celebration. This is due to the possible adverse effects that heat can have on buttercream.

If your cake starts to show effects of the heat, it may be advisable to cut the cake earlier than you had originally planned to ensure you get the best possible photos.

Allergen Advice

It is the responsibility of the customer to advise Simone Louise Cakes of any known food allergies.

Due to the way our cakes are prepared it is not possible to guarantee the absence of allergens in our products.
